Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Maiky website and the Maiky platform (the "Service"), operated by Maiky BV (BE0718712887), Belgium. By accessing or using the Service you agree to be bound by these Terms.

2. The service

Maiky provides a governance, risk and compliance (GRC) and information-security management platform. Specific features and limits depend on your subscription tier as described on our pricing page.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date.

4. Subscriptions and payment

Paid plans are billed in advance on a monthly or annual basis according to the plan and company size you select. Annual plans are billed for the full term. Fees are exclusive of VAT unless stated otherwise.

5. Acceptable use

You agree not to misuse the Service, including by attempting to gain unauthorised access, disrupting its operation, or using it in violation of applicable laws.

6. Data protection

Our processing of personal data is described in our Privacy Policy. You remain the controller of the data you upload to the platform.

7. Intellectual property

The Service, including its software, design and content, is owned by Maiky BV and protected by intellectual-property laws. These Terms do not grant you any ownership rights in the Service.

8. Availability and support

We aim to provide a reliable Service. Availability commitments, where offered, are set out in your subscription agreement. We may perform maintenance and update the Service from time to time.

9. Liability

To the maximum extent permitted by law, the Service is provided "as is". Maiky's aggregate liability is limited to the fees paid in the twelve months preceding the event giving rise to the claim.

10. Termination

You may cancel your subscription at any time, effective at the end of the current billing period. We may suspend or terminate access for breach of these Terms.

11. Governing law

These Terms are governed by Belgian law. Disputes are subject to the exclusive jurisdiction of the competent courts of Belgium.
